Our services are delivered through various platforms, including but not limited to the GoHighLevel (GHL) platform for customer relationship management, automation, and marketing services.
Platform Usage (GoHighLevel)
Certain services are provided through the GoHighLevel (GHL) platform. By using our services, you acknowledge and agree to:
- Comply with GoHighLevel's terms of service and acceptable use policies
- Not use the platform for any unlawful purposes, including spam, harassment, or fraudulent activities
- Not attempt to gain unauthorized access to any portion of the platform or its related systems
- Use automated messaging features (SMS, email) only in compliance with applicable laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
- Maintain accurate and up-to-date contact lists and honor all opt-out requests promptly
- Not send unsolicited messages to individuals who have not provided explicit consent
Account Registration and Information
When you engage our services, we collect the following information:
- Name: For account identification and communication
- Phone Number: For service-related communications
- Email Address: For account access and notifications
- Company Name: For service customization and billing
- Billing Details: For payment processing

- You may request immediate deletion of billing information upon service termination
Payment Terms

- Payments are due according to the agreed-upon schedule
- Late payments may result in service suspension or additional fees
- All fees are non-refundable unless otherwise stated in your service agreement
- We reserve the right to modify pricing with 30 days' advance notice
Intellectual Property
Our Content: All content on our website, including text, graphics, logos, and software, is the property of Sidekick Creative Company, LLC and is protected by intellectual property laws.
Client Work: Upon full payment, clients receive ownership of custom deliverables as specified in their service agreement. We retain the right to display completed work in our portfolio unless otherwise agreed.
Third-Party Content: Some content may be licensed from third parties and is subject to their respective terms.
Prohibited Activities
You agree not to:
- Use our services for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Transmit any viruses, malware, or harmful code
- Attempt to interfere with the proper functioning of our services
- Use our platform to send spam or unsolicited communications
- Misrepresent your identity or affiliation
- Engage in any activity that could damage our reputation

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
No Guarantee of Results: We do not guarantee specific results from our marketing services. Marketing outcomes depend on many factors beyond our control, including market conditions, competition, and your business operations.
We are not affiliated with, partnered with, or endorsed by Meta (Facebook/Instagram), Google, or any other third-party platform.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDEKICK CREATIVE COMPANY, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.
Our total liability shall not exceed the amount paid by you for services during the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Sidekick Creative Company, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
Termination
Either party may terminate services according to the terms of the service agreement. Upon termination:
- Access to platform features and services will be revoked
- Billing information will be deleted as described in these Terms
- Outstanding payments remain due and payable
- Provisions that by their nature should survive termination will remain in effect
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Arkansas.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
